Terms of Service.

These terms are a contract between you and TABEDAL, a French société par actions simplifiée (SAS) with a share capital of €1,000, registered with the Nanterre Trade and Companies Register under number 844 585 018, whose registered office is at 32 Rue de Paris, 92100 Boulogne-Billancourt, France, VAT number FR24844585018 ("TABEDAL", "we"). TABEDAL operates the website and service openfame.app ("OpenFame", the "Service"). By creating an account or buying anything on OpenFame, you accept these terms.

1. What the service is.

OpenFame is a public marketplace for promotional placements. It sells visibility, and nothing else: a numbered spot on a public leaderboard (the "Board"), a single premium placement at the top (the "Throne"), short public posts (the "Wall"), and a permanent public record of what those three cost (the "Hall of Fame"). Each placement displays a link chosen by its holder, a website or an X profile. Every price is posted, every transaction is recorded in a public journal, and nothing about the mechanism is hidden: the full rules are published in the rulebook and apply as written.

The rulebook forms part of these terms. It carries the figures this document does not repeat the daily fee and its period, the resale bounds, the liquidation slope and its floor, the reclaim delay, the quote freeze, the per-account limits and the terms of the Wall, and it is the version in force at the time of a transaction that applies to it. Every change to it is a dated line in the public journal, published before it takes effect. Where the two differ, the canister decides: it is the program that prices, records and enforces, and both documents describe it.

OpenFame is an advertising service. It is not an investment, not a financial product, not a game of chance, and holds no element of randomness: every outcome follows deterministically from posted prices and the published rules.

2. Who may use it, and how an account works.

You must be at least 18 years old and legally capable of entering into contracts. You sign in with an X account; your public X handle is displayed on the placements you hold. You are asked to declare your country. One person may operate one account. You are responsible for everything done through your account.

3. How a spot on the Board works.

Each Board spot shows a posted price at all times. Anyone may buy any spot by paying its posted price plus a buyer fee of 5% and, where due, a daily fee for the upcoming period, the exact total is displayed before you confirm payment. When your purchase completes, you become the spot's holder, you set its new posted price (within the published bounds, currently up to $20,000), and your link goes live after the checks in section 9.

When someone buys a spot from you, that is the Service working as designed: 90% of the price paid is credited to you (section 8) and the spot passes to the buyer. Being outsold is not a malfunction, a loss event, or grounds for a refund; it is the resale mechanism you joined the marketplace to use.

Unsold or newly opened spots follow a public declining-price schedule until bought. A holder who stops paying the daily fee enters liquidation: the spot's price declines publicly until someone buys it or it returns to the house. You may end your placement at any time from your account ("walk away"): the daily fee stops being charged immediately and the spot enters the same liquidation from its then-current price. Fee periods already paid are not refunded, and ending a placement is final, the spot can only be reacquired by buying it like anyone else. New spots may open ("drops") only under the published market conditions.

4. How the Throne works.

The Throne is a single premium placement attributed to the highest standing offer. Its current price is always posted. You may take the Throne by paying at least the posted minimum (the current price plus the published increment); your payment is the new posted price. When someone takes the Throne after you, your tenure ends and your payment is not returned, your payment bought the placement for the time you held it, exactly as described, and holding it "until outbid" is the product itself. You will be asked to expressly confirm that you understand this before every take. Seasons, the takeover cap (currently $20,000, which ends the season), reset countdowns and per-account cooldowns follow the published parameters.

5. How the Wall and the points work.

Wall posts are paid public messages, limited per account per week, subject to section 9. Points are a non-monetary score awarded for activity under published weights. Points have no cash value, cannot be bought, sold or redeemed, and confer no rights; weights may be adjusted with a public journal entry.

6. How the Hall of Fame works.

The Hall of Fame is a permanent public record of what the Board, the Throne and the Wall have cost. It keeps each finished season with the take that won it, each sale with the price paid, and each Wall post as it was written once its week has ended, shown as text and no longer clickable. It carries the public X handle of the account that paid, because a record of what somebody paid for a placement is not a record if it does not say who paid.

Entries are not removed on request, and no payment removes one. Two exceptions: a placement removed by moderation under section 9 is never archived, and erasing your account under the privacy policy removes your handle from Hall entries, which then stand as prices attached to an internal number.

7. What you pay, and what is not refunded.

Payments are processed by Stripe. We never see or store your card details. Prices are displayed in United States dollars and net of taxes; any value-added tax due is added at checkout according to your country and shown before you confirm. Anti-fraud checks (including 3-D Secure) may apply. Published rate limits apply, currently: 5 purchases per hour, 10 price quotes per minute, and a $20,000 maximum per sale and per Throne take.

All sales are final. Except where the law grants you rights that cannot be waived, or where a technical error on our side prevented the service you paid for from being delivered at all, payments are not refunded, in particular, being outsold on the Board (you receive 90% of the resale) and being succeeded on the Throne (section 4) are the normal operation of the Service and are never refundable.

Right of withdrawal (EU consumers). The Service is a digital service performed immediately and in full upon purchase: your placement goes live at once. By confirming a purchase you expressly request immediate performance and acknowledge that, once the placement is delivered, you lose your right of withdrawal in accordance with Article L221-28 of the French Consumer Code.

8. How a seller is paid.

Seller proceeds (90% of a resale) are paid through Stripe Connect. To receive money you must complete Stripe's onboarding for an Express account (identity verification and payout details, handled by Stripe in your country). Payouts carry a standard delay, currently 7 days, which protects the marketplace against fraud and disputes. If you never complete onboarding, your proceeds remain reserved for you for the period required by law. Amounts due to you are not interest-bearing.

9. What may be linked, and how it is reviewed.

Your link and its destination must be lawful and honest. Prohibited, without limitation: sexually explicit content; scams, deception or impersonation; malware or phishing; counterfeit goods; gambling services; redirect chains that mask the true destination; and any content unlawful in France or the European Union. Links must use HTTPS. A placement may also carry one short line of the holder's own words saying what they are asking a visitor to do, at most ninety characters, containing no web address. It is the holder's statement and not ours: we do not check it, endorse it or guarantee it, and it is subject to the same prohibitions and the same review as the link beside it. Every link is checked automatically before going live and at every change, and may be reviewed by a human.

Reporting a placement. Every placement carries a report control, and anyone may use it without an account. A report is recorded before it is acknowledged, you receive a reference immediately and a receipt by email, and the decision, whether the placement stays, is frozen or is removed, is sent to you with the reasons for it, quoting that reference. Reports made in bad faith or in volume may be disregarded.

We may freeze a placement's display when a link appears to violate these rules: the position is kept but the display is hidden pending review. A second freeze has the published structural consequences, forced liquidation for a Board spot, loss of tenure without refund and a new season for the Throne, and removal for a Wall post. Anyone may report a link; we operate a notice-and-takedown process consistent with the EU Digital Services Act, reachable at the address on the contact information. Illegal-content decisions can be contested by replying to the notification you receive.

10. What counts as fair play.

A published ceiling applies to the number of Board spots one account may hold (currently 5). A referral pays the buyer fee on the purchase it brought, and never on a purchase of your own. Reading the Service by program is free and unrestricted: the Board, the journal and the rules are published for machines as much as for people. Writing is not. Every purchase, take, post, price change and report is made through the account of a person who answers for it, and automated access that manufactures clicks, prices or points is a breach of these terms; we may revoke it without notice. Manufacturing activity to game visibility, prices or points, including click fraud, is prohibited. We may reverse the effects of transactions obtained through fraud or in breach of these terms; reversals are recorded in the public journal.

11. What the public journal keeps.

The marketplace's events, sales, prices, takes, parameter changes, moderation actions, are recorded in an append-only public journal, visible to anyone. This transparency is a core feature of the Service. The journal records account numbers and transaction facts; what happens to personal identifiers is described in the Privacy Policy.

12. How the service may change.

The published parameters (fees within the ranges stated here, price bounds, limits, schedules, point weights) may change prospectively; every change is announced by an entry in the public journal before it applies. We may modify these terms for the future with reasonable notice on the site; your continued use after notice is acceptance. The Service may be paused for safety or maintenance; the published pause rules apply.

13. How an account ends.

You may stop using OpenFame at any time and request erasure of your account once you no longer hold placements; erasure removes your identifiers as described in the Privacy Policy. We may suspend or terminate accounts that break these terms, with the consequences published in the rules; amounts lawfully due to you as a seller remain payable.

14. What we are and are not liable for.

Nothing in these terms excludes liability that cannot be excluded under French law, including for consumers. The Service is provided with reasonable skill and care; we do not promise any level of traffic, clicks, attention or commercial results from a placement, clicks shown on the site are measurements, not guarantees. To the extent permitted by law for business users, our total liability for any claim is capped at the fees you paid us in the twelve months before the event giving rise to it.

15. Who owns what.

OpenFame's name, marks, design and software are TABEDAL's property or licensed to it. You keep the rights to your own content and grant us the licence needed to display it on the Service and in the journal.

16. Which law applies, and where a dispute goes.

These terms are governed by French law. Consumers also enjoy the mandatory protections of their country of residence. Consumers in France may use, free of charge, a consumer mediator. TABEDAL is registering with a certified consumer-mediation scheme; the mediator's name and contact details will be published here and on the legal notice as soon as that registration is complete. Consumers in the European Union may also use the European Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr. Courts of the defendant's domicile, or any venue the law allows a consumer to choose, have jurisdiction.
